These terms are an agreement between you and the independent developer of Battle of Myths ("we", "us") about the Battle of Myths game ("the game"), its online services and the website battleofmyths.com (together, "the service"). By installing or playing the game, or using the website, you agree to these terms and to our privacy policy. If you don't agree, don't use the service.
Nothing in these terms takes away rights you have as a consumer under laws that can't be changed by contract. Where such a law applies, the terms below apply only as far as it allows.
1. Who may play
You must be 16 or older. By playing you confirm that you are. One account per person; you are responsible for everything done with your account and for keeping your device and sign-in safe.
2. Your licence to play
The game, its art, music, text, code, names and logos belong to us or our licensors. We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the game for your own non-commercial entertainment. You may not copy, sell, rent or modify the game, reverse engineer it, or use it to make other products, except as the law expressly allows.
3. Accounts
A guest account lives only on the device that made it. If you uninstall the game or lose the device before you link Sign in with Apple or Google, the account and everything in it is lost, and we can't restore it. You can delete your account at any time in Settings.
4. Gold, items and purchases
- Gold, pantheons, arenas, avatars, skins and other virtual items are a limited licence to use content in the game. They are not property, have no value outside the game, and can't be exchanged for money, transferred, sold or traded, in or outside the game.
- Purchases are made through the App Store or Google Play and are subject to their terms. The price and what you get are shown before you pay.
- All purchases are final. We don't give refunds, for Gold, items or unused Gold, except where the law requires it. Any refund request goes to Apple or Google, who decide it under their own rules.
- If Apple or Google refund or reverse a purchase, we may remove the Gold or items it paid for, or what was bought with them; if they were already spent, your Gold balance may go below zero until it is made up.
- Virtual items are delivered to your account immediately after purchase. By buying, you ask us to start delivery at once and you acknowledge that you lose your right of withdrawal once delivery has begun, as EU and Serbian consumer law allows for digital content.
- We may change, rebalance or remove virtual items and game content, for example to keep the game fair. Unused Gold and items are not refunded when an account is deleted, suspended for breaking these terms, or when the service ends, except where the law requires it.
- If something you paid for doesn't arrive, write to us and we will deliver it or make it right.
5. Free Gold (invites, shares and videos)
Rewards for invites, shares and videos are a promotion we may change or end at any time. We decide whether a video or invite qualifies, and we may refuse or take back rewards earned by fake accounts, cheating or abuse. By sending us a video link you allow us to show and link to that video, with credit, on our channels.
6. Fair play
Don't cheat, use bots, exploits, modified clients or automation; don't attack, overload or interfere with the servers; don't share, sell or buy accounts; don't pick a player name that is offensive, impersonates someone or breaks the law; and don't harass other players. We may rename, warn, suspend or delete accounts, remove items or rewards, or reset progress that comes from breaking these rules, without refund except where the law requires it.
7. The service can change
The game is a live service. We update, rebalance, add and remove content, and we may change or end features. We don't promise that the service will always be available, uninterrupted or error-free. We may end the online service; we will give at least 30 days' notice in the game or on the website first.
8. No warranty
The service is provided "as is" and "as available". As far as the law allows, we give no warranties, express or implied, including that the service is fit for a particular purpose, free of errors or always available. Your statutory rights for faulty digital content are not affected.
9. Limits on our liability
As far as the law allows, we are not liable for indirect or consequential loss, lost profits, lost data or progress, or losses caused by events outside our reasonable control, by app stores, networks or devices, or by other players. Our total liability to you for all claims is limited to the amount you paid us in the 12 months before the claim, or 50 euros if that is more.
These limits don't apply to liability that can't be limited by law, including liability for intent or gross negligence, or for death or personal injury caused by our negligence.
10. Health
A small number of people may have seizures when exposed to flashing lights or patterns, as in video games. If you or your family have a history of epilepsy, ask a doctor before playing, and stop playing at once if you feel unwell. Take regular breaks.
11. Ending this agreement
You can stop at any time by deleting your account and the game. We may suspend or end your access if you break these terms, if the law requires it, or if we end the service. Sections 2 (ownership), 4, 8, 9 and 13 continue after the agreement ends.
12. Changes to these terms
We may update these terms, for example when the game or the law changes. We'll update the date at the top and show important changes in the game before they take effect. If you keep playing after that, the new terms apply; if you don't agree, you can stop playing and delete your account.
13. Law and disputes
These terms are governed by the law of the Republic of Serbia, and disputes go to the competent court in Serbia. If you are a consumer living in another country, you also keep the protection of the mandatory laws of your country and may bring a claim in your country's courts. Please write to us first at [email protected]; most problems can be solved quickly.
14. Apple and Google
These terms are between you and us, not Apple or Google. Apple and Google are not responsible for the game or its support, maintenance, warranties, product claims or third-party rights. If the game fails a warranty that applies by law, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a US embargo and not on a US list of prohibited or restricted parties.
15. General
If any part of these terms is found invalid, the rest stays in effect. If we don't enforce a term at once, we haven't waived it. We may transfer this agreement to a company that takes over the game; your rights under it stay the same. These terms and the privacy policy are the whole agreement between us about the service.
